    I am pleased that you are visiting my website and thank you for your interest in my websites www.open-cards.de and www.open-cards.com (in summary: my website). Privacy and data security in the use of my website are very important to me. I would therefore like to inform you here which of your personal data I collect when you visit my website and for what purposes these are used.

    Since changes in the law or changes in my internal processes may make it necessary to adapt this data protection declaration, I ask you to read this data protection declaration regularly.

    § 3 Principles of data processing

    Personal data is any information that relates to an identified or identifiable natural person, such as your name, age, address, telephone number, date of birth, e-mail address, IP address or user behavior; information that I cannot relate to you (or only with disproportionate effort), e.g. by anonymizing the information, is not personal data; the processing of personal data (e.g. the collection, retrieval, use, storage or transmission) always requires a legal basis or your consent. Processed personal data will be deleted as soon as the purpose of the processing has been achieved and no legally prescribed retention obligations are to be observed.

    If I process your personal data for the provision of certain services, I will inform you below about the specific processes, the scope and purpose of data processing, the legal basis for processing and the respective storage period.

    § 4 Individual processing operations

    1. Provision and use of the website

    a. Type and scope of data processing

    When you access and use my website, I collect the personal data that your browser automatically transmits to my server, which is temporarily stored in a log file, and when you use my website, I collect the following data that is technically necessary for me to display my website and to ensure its stability and security:

    • IP address of the requesting computer
    • Date and time of access
    • Name and URL of the retrieved file
    • Website from which access is made (referrer URL)
    • the browser used and, if applicable, the operating system of your computer, as well as the name of your access provider

    b. Legal basis

    For the aforementioned data processing art. 6 par. 1 lit. f GDPR serves as legal basis, the processing of the aforementioned data is necessary for the provision of my website.

    c. Storage time

    As soon as these data are no longer required to display the website, they will be deleted. The collection of the data for the provision of the website and the storage of the data in log files is mandatory for the operation of the website and therefore there is no possibility of objection on the part of the user. Further storage may take place in individual cases if this is required by law..

    2. registration / user account

    a. Type and scope of data processing

    On my website, I offer you the opportunity to register by providing personal data: https://open-cards.de/users/register or at https://open-cards.com/users/register. This gives you access to functions of my website that are reserved exclusively for registered users.

    With the processed data I create an individualized user account for you.

    I will process your email address so that I can send you new access data for your user account in case you forget them.

    The following overview shows you in detail which personal data I process when you register on my website:

    • "User name openCards"* (will be assigned during the first registration on the basis of a name proposed by you - unique for all registered users)

    Only your e-mail address, your “user name openCards”, your first and last name and the country in which you currently live are mandatory data for registration (marked with an * above) and will be processed together with your technically determined IP address. All other information will only be processed if you provide it voluntarily during registration or voluntarily add it to your profile at a later date.

    When you request your data during registration, you can determine who may subsequently see your data on my website (hereinafter referred to as "visibility control") by selecting one of the following options per entry in the profile data:

    • "Visible to all openCards users" - Everyone who registers on my website can see this information, for example when calling up your personal profile.
    • "Visible to all your "contacts" - Any user registered on my website with whom you have networked on my website can see this information (cf. § 4 Section 9 "Contacts").
    • "Visible to No One" - With this setting, the information you enter in your profile is not visible to any user of my website except yourself.

    Note: The following fields are excluded from this function ("Control Visibility):

    • User name openCards: The user name is used to identify all content you create on my website and is always visible to all users of my website as long as you do not close your user account.
    • Email address: Your email address is only visible or changeable for yourself in your profile and in principle NOT visible for other users of my website.
    • Country: The country in which you currently live is always visible to all users of my website and is used for various statistics that are accessible to all users.
    • IP address: Your IP address is processed exclusively for technical operation and log files created in this context and is not visible to any user of my website.

    In order to give you more control over who may see your data than these settings, I offer you two further setting options within the scope of registration and in your user profile, with which you can further restrict the visibility of your data:

    1. "My profile should be visible to non-members." (Yes/No query)
    2. "My profile should be visible to Internet search engines." (Yes/No query)

    Using the first setting you can use the default "No" to ensure that non-registered users of my website with the exception of your "user name openCards" are not shown any further data from your profile (regardless of the settings for "Visibility control" described above).

    With the second setting you can use the default "No" to ensure that search engines that access my website cannot evaluate any data from your profile.

    Even after registration on my website these configuration options are available to you in your user profile and can therefore be changed at any time according to your wishes.

    Note on the "Address" and "Telephone number" data

    Your address (street + house number; zip code; city) and your telephone number will only be recorded and processed as mandatory information if you as tournament director want to publish your own tournaments on my website (see §4 Section 12  "Tournament announcement and registration"). For all other functions of my website these data are not relevant.

    Further voluntary information in your profile

    As a registered user you can enter further voluntary data in your profile:

    1. Information about your preferred game systems
    2. Information on the form in which the data is presented to you on the start page of my website after registration (pure data for the configuration of my website and therefore no personal data).

    When specifying your preferred game systems, you can indicate whether you are collecting this game system, playing with friends and/or playing at tournaments; this information will be used on my website to generate statistics and to give you dynamic hints on further functions of my website.

    Functions of my website for registered users

    After successful registration on my website the following additional functions are available for registered users, which are described in detail in the following sections:

    • Private Messages: Use the "private messages" function to send and receive messages to and from other users of my website. This "inbox" is part of their user account on my website. See §4 section 4.
    • Comment function: Publishing comments on the content on my website, see also §4 section 5.
    • Participation in discussions: This feature includes participating in discussions and starting your own discussions in the forums available for the different game systems on my website. See §4 section 6.
    • Publish articles: You can publish your own articles on my website so that they can be read by all users on my website The following types of articles are available to you as a registered user depending on the respective game system: "News"; "Interview"; "Card Review"; "Strategy Articles"; "Deck"; "Tournament"; "Tournament Report"; "Fun-Stuff"; "House-Rule"; "Dreamard". As the author of these articles, you are responsible for their content. See also §4 Section 7.
    • Tradeplace: The use of the card exchange on my website allows you to manage your own collection of cards per game system and to publish exchange lists (offers & requests) so that they can be viewed by all users of my website. See also §4 section 8.
    • Contacts: This function allows you to add other registered users of my website to your contacts, to make data from your profile "visible" to your contacts that is not displayed to other users of my website, and to invite new users to use my website (see also §4 section 9).
    • Groups: This function allows you to create a group to which other users can then join my website, you can also join existing groups yourself, and you can send messages to groups to several users of my website at the same time via the "private messages" function, see also §4 section 10.
    • Maintenance card database: As a registered user you can support me in the maintenance of the existing card database for each game system, which contains all card of a game system, see also §4 section 11.
    • Tournament announcement & publish results: As a registered user you have the possibility to announce tournaments and publish the results of your tournament on my website. See §4 section 12.
    • Tournament registration: For tournaments registered on my website (see tournament announcement) you as a registered user have the possibility to register online, so that the tournament director will be informed in advance of his tournament that you intend to participate in his tournament and that a tournament director can enter your "openCards username" as a participant in his tournament to publish the results of his tournament. See also §4 section 13.
    • "Hall of Fame": As a registered user of my website, you collect "honor points" for the activities you perform on my website; the users with the most "honor points" are displayed in the "Hall of Fame" for all users of my website; see also §4 Section 14.

    A large part of these functions serves to enable you to publish content on my website (in the future called "content") This content is always linked to and stored by your "user name openCards" with your user account in order to make it comprehensible to all users of my website from whom which content originates on my website and when it was published.

    You are responsible for the content of this page and are obliged to comply with the terms of use of my website (see terms of use).

    b. Legal basis

    According to Art. 6 para. 1 lit. a GDPR, the aforementioned data processing is based on the declaration of consent voluntarily given by you under §2 section 14 "Declaration of consent".

    c. Storage time

    Even after your user account has been closed, it may be necessary to store personal data in order to comply with legal obligations; further storage may take place in individual cases if this is required by law.

    d. Dissolution of the registration

    As a user you have the possibility to cancel your registration at any time (your user account with all personal data contained therein will be deleted, the link to content created by you on my website will be anonymized) by clicking on the "cancel user account" button in your user account.

    Content created by you on my website will not be completely deleted when your user account is closed, but will only be anonymized in parts.

    The following data will be deleted:

    • Your user account with all data contained therein (§4 Section 2)
    • Your Exchange Lists in the Tradeplace (§4 Section 8)
    • Your contacts (§4 section 9)
    • Your groups (§4 section 10)

    All other types of content that you have created on openCards will not be deleted from my website, but anonymized when your user account is closed, see §2 section 7.

    This means that this content will be reassigned to a newly created anonymous user ("anonymous user X", where X is a randomly selected five-digit number) when your user account is closed and can therefore no longer be assigned to you or your user account.

     

    3. Newsletter

    a. Type and scope of data processing

    You can subscribe to a free newsletter on my website and I need the following information to be able to send you the newsletter regularly:

    • Email - Address
    • "Username openCards"

    The openCards Newsletter includes information about (new) generally functions of openCards and news around the different supported game systems.

    Your data will not be passed on to third parties in connection with sending the newsletter.

    b. Legal basis

    The processing of your e-mail address for sending newsletters is based on your voluntary declaration of consent pursuant to Art. 6 para. 1 lit. a GDPR:

    Declaration of consent:

    By activating the "Newsletter" function during registration or in my user profile, I agree to the processing of my e-mail address for the regular sending of a notification e-mail, which I can deactivate at any time in my profile, I have read and accept the current data protection statement and I can revoke my consent to the collection of personal data collected during the registration process at any time by contacting policy@open-cards.com

    c. Storage time

    Your e-mail address will be stored for as long as you are registered as a user on my website. Further storage may take place in individual cases if this is required by law.

     

    4. Private messages

    a. Type and scope of data processing

    The "Private Messages" feature on my website provides a feature that allows you to send and receive messages from other registered users of my website, but these messages remain exclusively on my website and are not sent to external email addresses.

    Depending on the settings in your profile, not only your "username openCards", but also your full first and last name will be displayed on my website together with the "private messages" sent by you for the recipient of the respective message.

    In your user profile you have the possibility to activate the function that sends you an email whenever you have received a new private message, which contains only a note that you have received a new private message on my website and a link to your private messages on my website (registration required for access).

    In the context of this function, I process the following personal data of yours:

    • Email - Address
    • "Username openCards"

    b. Legal basis

    According to Art. 6 para. 1 lit. a GDPR, the aforementioned data processing is based on the declaration of consent voluntarily given by you under §2 section 14 "Declaration of consent".

    c. Storage time

    Private messages" published by you on my website will remain permanently on my website, even after termination of your user account.

    When you terminate your user account, the "private messages" you have created will be made anonymous, meaning that your "private messages" will be reassigned to a newly created anonymous user ("anonymous user X", where X is a random five-digit number).

    This ensures that the "private messages" you originally created cannot be assigned to you or your user account via the "openCards" user name.

     

    5. Comment function

    a. Type and scope of data processing

    There are several places on my website where you can comment on the content displayed on a page.

    A comment published by you will always be linked to your "username openCards" and saved. Depending on the settings in your profile, not only your "username openCards" and the date of publication, but also your full first and last name will be displayed on my website together with the comments you have published.

    As the author of these comments, you are responsible for their content, and I reserve the right to delete content that violates these Terms of Use in accordance with my Terms of Use.

    In the context of this function, I process the following personal data of yours:

    • "Username openCards"
    • First name (depending on the visibility settings in your user profile)
    • Last name (depending on the visibility settings in your user profile)

    b. Legal basis

    According to Art. 6 para. 1 lit. a GDPR, the aforementioned data processing is based on the declaration of consent voluntarily given by you under §2 section 14 "Declaration of consent".

    c. Storage time

    Comments you post on my website will remain on my website permanently, even after your account is terminated.

    When you terminate your account, your comments will be made anonymous, meaning that your comments will be reassigned to a newly created anonymous user ("anonymous user X", where X is a random five-digit number).

    This ensures that the comments you originally created can no longer be assigned to you or your user account via the "user name openCards".

     

    6. Participation in discussions

    a. Type and scope of data processing

    On my website different forums are offered to the individual game systems and to the general functions of my website. In these forums you as a registered user can start your own discussions and publish your own discussion contributions to existing discussions (in the following "discussion contributions").

    Depending on the settings in your profile, not only your "username openCards" and the date of publication of your discussion post, but also your full first and last name will be displayed on my website together with your published discussion posts.

    You are responsible for the content of these discussion posts and I reserve the right to delete content that violates these Terms of Use in accordance with my Terms of Use.

    In the context of this function, I process the following personal data of yours:

    • "Username openCards"
    • First name (depending on the visibility settings in your user profile)
    • Last name (depending on the visibility settings in your user profile)

    b. Legal basis

    According to Art. 6 para. 1 lit. a GDPR, the aforementioned data processing is based on the declaration of consent voluntarily given by you under §2 section 14 "Declaration of consent".

    c. Storage time

    Discussions posted by you on my website will remain permanently on my website, even after termination of your user account.

    When you cancel your user account, the discussion posts you have created will be made anonymous, which means that your discussion posts will be reassigned to a newly created anonymous user ("anonymous user X", where X is a randomly selected five-digit number).

    This ensures that the discussion posts you originally created can no longer be assigned to you or your user account via the "user name openCards".

     

    7. Publishing articles

    a. Type and scope of data processing

    On my website you have the possibility to publish the following types of articles under your user:

    • Big-Events
    • Decks
    • Interviews
    • House-Rules
    • Card-Reviews
    • News
    • Rule-Documents
    • Fun-Stuff
    • Strategy-Articles
    • Tournaments
    • Tournament-Reports
    • Dream-Cards

    The differences between the different types of articles are explained on my website and the types of articles available to you as a registered user on my website may vary per game system.

    Depending on the settings in your profile, not only your "username openCards" and the date of publication, but also your full first and last name will be displayed on my website together with the articles you have published.

    As the author of these articles, you are responsible for their content and I reserve the right to delete content that violates these Terms of Use in accordance with my Terms of Use.

    In principle, you have the possibility to save a draft of all articles, which can only be viewed and edited by yourself via your profile; other users of my website do not have access to articles that have been saved as a draft; only when you publish your article will it become visible to all users on my website.

    In the context of this function, I process the following personal data of yours:

    • "Username openCards"
    • First name (depending on the visibility settings in your user profile)
    • Last name (depending on the visibility settings in your user profile)

    b. Legal basis

    Articles published by you on my website will remain permanently on my website, even after termination of your user account.

    When you cancel your account, the articles you have created will be made anonymous, which means that your articles will be reassigned to a newly created anonymous user ("anonymous user X", where X is a random five-digit number).

    This ensures that the content you originally created is no longer assigned to you or your user account via the "user name openCards".

     

    8. Tradeplace

    a. Type and scope of data processing

    On my website you as a registered user have the possibility to manage your card collection and to publish exchange offers and requests to the different game systems shown on my website.

    Depending on the settings in your profile, not only your "username openCards", but also your full first and last name will be displayed on my website together with the lists you have created, and the last time you updated this list will be saved for each list.

    The exchange lists you create under the heading "Collection" are only visible to you and cannot be viewed by other users of my website, but the exchange lists you create are visible to every user of my website and are used in the "Tradefinder" function to automatically find and display exchange possibilities between users of my website (the results of "Tradefinder" show results in the following sense: user X searches for a card and user Y offers them).

    In the context of this function, I process the following personal data of yours:

    • "Username openCards"
    • First name (depending on the visibility settings in your user profile)
    • Last name (depending on the visibility settings in your user profile)

    To initiate an exchange with another user of my website, you can use the function "Private Messages" (see §2 Section 4).

    b. Legal basis

    c. Storage time

    With the termination of your user account, the requests/offers you have made on my site and the information on your collection will be deleted within 3 months.

     

    9. Contacts

    a. Type and scope of data processing

    With the "Contacts" function on my website, I offer you the possibility of networking with other registered users of my website, either by sending a contact request to another user who accepts your request, or by accepting a contact request sent to you by another user of my website.

    Once you have networked with a user, this user will be displayed with a summary of his profile data on the "myContacts" page, which is only visible to registered users and is always personalized for the user who visits this page, as well as indicating that this is one of your contacts when you visit a page that displays his "user name openCards" (e.g. because the content displayed on the page originates from this user).

    For your contacts, you can set separately in your profile which data from your profile is visible to your contacts, which settings may differ from those that apply to users of my website with whom you are not networked (cf. Visibility of data under §2 Section 2).

    At any time, you have the option of cancelling a network with another user once it has been established ("Delete" link on the "myContacts" page for each closed contact).

    With the cancellation of your user account, the contacts you have created on my site will be deleted within 3 months.

     

    10. Groups

    a. Type and scope of data processing

    On my website you as a registered user have the possibility to create groups or to join existing groups, which are used to send messages to a group of users using the function "private messages" (cf. §2 section 4).

    Groups are always public to all users of my website, the list of members of a group is public to all users of my website.Itt is not possible to create closed groups, which means that any registered user of my website can join a group, even if you have created a group yourself, you do not have the right to exclude other members of the group from the group.

    If you create a group yourself, it will always be linked and saved with your "username openCards" and, depending on your professional settings, not only your "username openCards" and the date you joined, but also your full first and last name will be displayed on my website together with the group you created.

    When you join a group, your membership in that group will always be linked and saved with your "username openCards", and depending on the settings in your profile, not only your "username openCards", but also your full first and last name will appear in the group's member list on my website.

    In the context of this function, I process the following personal data of yours:

    • "Username openCards"
    • First name (depending on the visibility settings in your user profile)
    • Last name (depending on the visibility settings in your user profile)

    b. Legal basis

    According to Art. 6 para. 1 lit. a GDPR, the aforementioned data processing is based on the declaration of consent voluntarily given by you under §2 section 14 "Declaration of consent".

    c. Storage time

    Upon termination of your account, your membership in all groups you are a member of will be terminated within three months, including groups you have created, and if you are the only member of those groups, the group will be terminated at the same time.

     

    11. Maintenance card database

    a. Type and scope of data processing

    As a registered user on my website, you can participate in the collection of newly published trading cards; as a rule, I enter new cards in the database and two other users of my website can then check and confirm them in order to avoid data entry errors and ensure the quality of the database with regard to search queries, for example; you can also support me in the initial collection of the cards when setting up new game systems.

    To help you capture cards in the card database, you will receive "honor points" for the "openCards Hall of Fame" (see also §2 Section 14 "Hall of Fame") by linking and saving the capture of the card or the check you have made with your "user name openCards" Depending on the settings in your profile, not only your "user name openCards" and the date of your capture, but also your full first and last name will be saved on my website together with the card you captured or checked.

    In the context of this function, I process the following personal data of yours:

    • "Username openCards"
    • First name (depending on the visibility settings in your user profile)
    • Last name (depending on the visibility settings in your user profile)

    b. Legal basis

    According to Art. 6 para. 1 lit. a GDPR, the aforementioned data processing is based on the declaration of consent voluntarily given by you under §2 section 14 "Declaration of consent".

    c. Storage time

    Cards that you have entered or verified on my website will remain on my website permanently, even after you cancel your account.

    When you cancel your user account, the reference to your support in the card database will be made anonymous, which means that the support you provided in the card database will be "rebooked" to a newly created anonymous user ("anonymous user X", where X is a randomly selected five-digit number). When a card is displayed, it will no longer refer to your user name, but to the newly created anonymous user.

    This ensures that the content you originally created is no longer assigned to you or your user account via the "user name openCards".

     

    12. Tournament Announcement & Publish Tournament Results

    a. Type and scope of data processing

    As a registered user of my website, you have the possibility to plan and "advertise" tournaments and to record the results of these tournaments. To use this function, I require that you enter your address data (city, street, house number, telephone number) in your user profile in addition to the minimum user data (surname, first name and e-mail address), whereby the visibility of this data can be limited to yourself.

    In the context of the "Tournament announcement" function, I process the following personal data from you:

    • "Username openCards"
    • First name (depending on the visibility settings in your user profile)
    • Last name (depending on the visibility settings in your user profile)
    • Street / house number (depending on the visibility settings in your user profile)
    • Postal code (depending on the visibility settings in your user profile)
    • Location (depending on the visibility settings in your user profile)
    • Phone number (depending on the visibility settings in your user profile)

    Afterwards you have the possibility to publish the participants of your tournament and the results of your tournament (see §2 section 13 "Tournament registration").

    As the author of the Tournament article, you are responsible for its content and I reserve the right to delete any content that violates these Terms of Use, subject to my Terms of Use.

    b. Legal basis

    The processing of your address data and your telephone number for the functions "Tournament Registration & Publish Tournament Results" is based on the voluntary declaration of consent submitted by you in accordance with Art. 6 para. 1 lit. a GDPR below:

    Declaration of consent:

    In order to use the functions "Tournament Announcement & Publish Tournament Results" on openCards, you need to enter my address and phone number in my profile and I hereby give my consent to the processing of my address and phone number in order to use this function.

    I have read and accept the current privacy policy and can revoke my consent to the processing of my personal data at any time by contacting policy@open-cards.com

    c. Storage time

    With the cancellation of your user account all information in your user profile including the address data will be deleted within 6 months.

    Tournaments published by you will remain on my website permanently, even after termination of your account.

    Termination of your account will make the tournament announcements you have created anonymous, meaning that your tournaments will be reassigned to a newly created anonymous user ("anonymous user X", where X is a consecutive number).

    This ensures that the content you originally created is no longer assigned to you or your user account via the "user name openCards".

     

    13. Tournament registration

    a. Type and scope of data processing

    On my website, as a registered user you have the possibility to register as a participant in tournaments published on my website in order to inform the tournament director in advance that you would like to participate.

    Furthermore, every user of my website who publishes the results of his tournament can enter your "username openCards" as a participant in his tournament (and then publish the corresponding results for this username on my website).

    If you register yourself for a tournament or if another user assigns you to his tournament as a participant, this registration or assignment will always be linked and saved with your "user name openCards". Depending on your professional settings, not only your "user name openCards" and the date of your accession, but also your full first and last name will be displayed on my website together with your registration for the tournament.

    In the context of the "Tournament registration" function, I process the following personal data from you:

    • "Username openCards"
    • First name (depending on the visibility settings in your user profile)
    • Last name (depending on the visibility settings in your user profile)

    b. Legal basis

    According to Art. 6 para. 1 lit. a GDPR, the aforementioned data processing is based on the declaration of consent voluntarily given by you under §2 section 14 "Declaration of consent".

    c. Storage time

    Tournament registrations published on my website and the results of a tournament, if any, will remain permanently on my website, even after termination of your user account.

    Upon termination of your account, the published tournament registrations and any results recorded for a tournament will be made anonymous, which means that they will be reassigned to a newly created anonymous user ("anonymous user X", where X is a randomly selected five-digit number).

    This ensures that this content is no longer assigned to you or your user account via the "user name openCards”.

     

    14. Hall of Fame

    a. Type and scope of data processing

    In the "Hall of Fame" those users are listed who have collected the most "Honor Points" on my website:

        1. For publishing articles (the author of the article or the person who published the article on my website receives "honor points").
        2. For articles to be "clicked" on my page (the author receives one "honor point" per "click").
        3. For support in the quality assurance of new cards in the card database, you will receive "honor points" for recording and quality assurance of the respective cards.
        4. For special merits on my website, e.g. the provision of card scans when building up the card database for new game systems.

    Depending on the settings in your profile, not only your "username openCards", but also your full first and last name will be shown on my website together with the honor points (see visibility of data under §2 section 2 - Registration and user account).

    To determine the "clicks" described under point 2, the user behaviour of the respective users of my website is recorded (user profile) by logging in a database all page views of content pages (cf. §2 section 7 "Publication of articles"), processing the page ID, the accessing user (user ID and host ID) and the time of access, and storing the clicks of non-registered users under the user ID "0", which is then used to calculate the respective "honor points" in the "clicks" area.

    In the context of this function, I process the following personal data of yours:

    • "Username openCards"
    • First name (depending on the visibility settings in your user profile)
    • Last name (depending on the visibility settings in your user profile)
    • Your page accesses to content pages (cf. § 2 Section 7 "Publishing articles") and the your support to the card database
    • Your User ID
    • Your host ID

    b. Legal basis

    The processing of your personal data for the "Hall of Fame" function is based, in accordance with Art. 6 Para. 1 lit. a GDPR, on the declaration of consent you have voluntarily given below:

    Declaration of consent:

    By registering on openCards, I agree to the processing of my first and last name, my chosen "user name openCards", my use ID and my host ID for the creation and storage of usage statistics on openCards.

    I hereby declare my agreement that an overview of all articles published by me will be displayed in the "Hall of Fame" for my "user name openCards" and my first and last name.

    I have read and accept the current privacy policy and can revoke my consent to the processing of my personal data at any time by contacting policy@open-cards.com

    c. Storage time

    The statistics per user including the listings of which articles have received how many "click honor points" are permanently stored (as long as your user account exists) and no longer contain a reference to the respective user, but only the pure number of "clicks".

    15. Declaration of consent

    The data processing mentioned in this paragraph in sections 2, 4, 5, 6, 7, 8, 9, 10, 11 and 13 are based on the voluntary declaration of consent given by you in accordance with Art. 6 para. 1 lit. a GDPR below.

    Declaration of consent:

    By registering on openCards, I consent to the processing of my first and last name, my e-mail address, the country in which I currently reside and the user name I have chosen "openCards" for the creation and storage of a user account on openCards, and I also consent to the processing of further data in my user profile, the collection of which is in my sole discretion and not necessary for the use of the website.

    By registering on openCards, I also agree to the processing of my "user name openCards" and my first and last name for the identification of content, which I myself have published on openCards.

    By registering on openCards, I agree to the processing of my "user name openCards" and my first and last name for the identification of registration and/or participation in tournaments, which were published either by myself or by other users on openCards.

    I have read and accept the current privacy policy and can revoke my consent to the use of my personal data at any time by contacting policy@open-cards.com

    § 5 Passing on of data

    I will only pass on your personal data to third parties if:

    • you have given your express consent pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR
    • according to Art. 6 para. 1 sentence 1 lit. c GDPR a legal obligation exists for the passing on of data
    • the disclosure pursuant to Art. 6 para. 1 sentence 1 f GDPR is necessary to safeguard legitimate interests and to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data.

    § 6 Use of cookies

    a. Type and scope of data processing

    I use cookies on my website, which are small files that I send to and store on your device's browser when you visit my website; some functions of my website cannot be offered without the use of technically necessary cookies, while other cookies allow me to perform various analyses, such as identifying  the browser you are using when you return to my website and transmitting various information to me; cookies enable me to make my website more user-friendly and effective, for example by tracking your use of my website and your preferred settings.

    Various types of cookies are used on my website, the type and function of which will be explained in more detail below.

    Art 1:

    transient cookies

    My website uses transient cookies that are automatically deleted when you close your browser, this type of cookie allows you to record your session ID, which allows me to associate different requests from your browser to a common session and to recognize your device when you visit the website later.

    Art 2:

    persistent cookies

    Persistent cookies are cookies that are stored in your browser for a long period of time and transmit information to me, depending on the cookie, and you can delete persistent cookies independently using your browser settings.

    Function 1:

    Required Cookies

    These cookies are required for technical reasons so that you can visit my website and use the functions. I offer, for example in the following applications: Firstly, cookies are used to automatically enter your personal data in the input mask on future logins in order to ensure your authorization.

    Function 2:

    Performance-related cookies

    These cookies enable me to analyze website usage and improve the performance and functionality of my website, such as how visitors use my website, which pages are most frequently visited, or whether error messages are displayed on certain pages.

    b. Legal basis

    Due to the described purposes of use (cf. § 6. a.) the legal basis for the processing of personal data using cookies lies in Art. 6 para. 1 lit. f GDPR If you have given me your consent to the use of cookies on the basis of a notice ("cookie banner") given by me on the website, the legality of the use is additionally governed by Art. 6 para. 1 lit. 1 lit. a GDPR.

    c. Storage time

    As soon as the data transmitted to us via cookies is no longer necessary for the purposes described above, this information will be deleted. Further storage may take place in individual cases if this is required by law.

    d. Configuring the browser settings

    Most browsers are set to accept cookies by default, but you can configure your browser to accept only certain cookies or no cookies at all, but I would point out that if cookies are disabled by your browser settings on my website, you may not be able to use all the features of my website, you can also delete cookies already stored in your browser, and it is possible to set your browser to notify you before cookies are stored.

    If you want a comprehensive overview of all third-party accesses to your Internet browser, I recommend the installation of specially developed plug-ins.

    § 7 Tracking and analysis tools

    No tracking and analysis tools such as Google Analytics (Google Inc) are used on my website.

    § 8 Plugins

    On my website no plugins are used e.g. for linking to social networks like "Facebook".

    § 9 Hyperlinks

    On my website there are so-called hyperlinks to websites of other providers. When activating these hyperlinks you will be redirected from my website directly to the websites of other providers, as you can see from the change of the URL, I cannot take responsibility for the confidential handling of your data on these websites of third parties, as I have no influence on whether these providers comply with the data protection regulations.

    § 10 Rights of the parties concerned

    The GDPR gives you as a data subject the following rights for the processing of personal data:

    • Pursuant to Art. 15 GDPR, you may request information about your personal data processed by me, in particular about the purposes of processing, the categories of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right of rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if not collected by me, about a transfer to third countries or international organisation and about the existence of automated decision-making including profiling and, if applicable, meaningful information.
    • In accordance with Art. 16 GDPR you can immediately demand the correction of incorrect or the completion of your personal data stored with me.
    • Pursuant to Art. 17 GDPR, you may request the deletion of your personal data stored by me, provided that the processing is not necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims.
    • Pursuant to Art. 18 GDPR, you may request the processing of your personal data to be restricted if you dispute the accuracy of the data, if the processing is unlawful, if I no longer need the data and if you refuse their deletion because you need them to assert, exercise or defend legal claims. You are also entitled to the right under Art. 18 GDPR if you have filed an objection to the processing pursuant to Art. 21 GDPR.
    • Pursuant to Art. 20 GDPR, you can request that the personal data you have provided me with be received in a structured, current and machine-readable format or you can request that it be transmitted to another person responsible.
    • In accordance with art. 7 para. 3 GDPR you can revoke your consent at any time, with the consequence that I may no longer continue the data processing based on this consent for the future.
    • According to Art. 77 GDPR, you have the right to complain to a supervisory authority, usually by contacting the supervisory authority of your usual place of residence, your workplace or my adress.

    § 11 Right of objection

    When processing your personal data on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 f GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that there are reasons for this which arise from your particular situation or the objection to direct advertising.

    § 12 Data security and security measures

    I commit myself to protect your privacy and to treat your personal data confidentially.  In order to avoid any manipulation, loss or misuse of your personal data stored with us, I take technical and organisational security precautions which are regularly checked and adapted to technological progress, but I would like to point out that due to the structure of the Internet it is possible that the rules of data protection and the above security measures of other persons or institutions not within my area of responsibility may not be observed, in particular unencrypted data - e.g. if this is done by e-mail. It is the responsibility of the user to protect the data provided by him against misuse by encryption or in any other way.
